These Terms & Conditions ("Terms") govern your access to and use of PilotIQ (the "Service"), at pilotiq.com.au and via our app. "PilotIQ", "we", "us" and "our" refer to Scott Rogers (ABN 97 245 817 101), a sole trader based in Victoria, Australia, of which "PilotIQ" is a registered business name. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About PilotIQ
PilotIQ is an independent study and exam-preparation platform for Australian CASA pilot theory examinations, including Recreational Pilot Licence (RPL) and Private Pilot Licence (PPL) theory for aeroplane and helicopter. PilotIQ also provides PilotIQ Logbook, a digital pilot logbook and currency-tracking application available on the Apple App Store, which records flights and monitors licence, medical, currency and recency requirements. PilotIQ is not affiliated with, endorsed by, or connected to the Civil Aviation Safety Authority (CASA). All content is created for educational and preparation purposes only and does not represent official CASA examination material.
2. Eligibility & your account
You must be at least 16 years old to use the Service. If you are under 18, a parent or guardian must read and agree to these Terms on your behalf, and consent to your use of the Service. You agree to provide accurate information and to keep your credentials secure. Accounts are for a single individual and may not be shared, sold or transferred.
Personal subscriptions are for individual study use. Flying-school and instructor use is supported through PilotIQ's school features — where a school creates an organisation and adds its instructors (charged per active instructor seat) and students — and is governed by these Terms together with any additional terms we agree with the school. Other institutional, classroom or commercial use requires our written agreement.
3. Subscriptions & billing
PilotIQ offers free and paid access. Where paid plans are enabled, subscriptions grant access to the selected features (for the Logbook app) or licence/aircraft track (for the theory platform) for the stated period and may renew unless cancelled before the end of the current period. The subscription title, length and price are shown before purchase. Prices may change with notice; changes do not affect the current paid period.
Apple App Store subscriptions (auto-renewable). PilotIQ Logbook offers an auto-renewable subscription ("PilotIQ Career"). Payment is charged to your Apple Account at confirmation of purchase. The subscription automatically renews for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal at any time in your Apple Account settings; deleting the app does not cancel the subscription. Any unused portion of a free trial period, where offered, is forfeited when you purchase a subscription.
4. Refunds
Where required by the Australian Consumer Law or other applicable law, your statutory rights are not affected. Any voluntary refund policy will be described at the point of purchase. Subscriptions purchased through an app store are subject to that store's refund process.
5. Cancellation
You may cancel at any time from your account. On cancellation you retain access until the end of your current paid period; we do not provide partial-period refunds except as required by law.
6. Acceptable use
You agree not to copy, scrape, resell, sublicense or redistribute any part of the Service or its content; share your account; attempt to disrupt, reverse-engineer or gain unauthorised access; or use the Service unlawfully.
Question-bank protection. You must not systematically extract, download, record, reproduce, distribute or create derivative works from any question bank, mock examination, explanation, image or educational content. Any attempt to recreate a competing product or database from the Service is strictly prohibited.
7. Account integrity
We may monitor account activity to detect account sharing, automated access or content extraction, and may suspend or terminate accounts that appear to be misused, in accordance with our Privacy Policy.
8. Intellectual property
All questions, explanations, software, text and graphics in the Service (excluding third-party content and your own inputs) are owned by PilotIQ or its licensors. We grant you a limited, personal, non-transferable, revocable licence to access and use the Service for your own exam preparation.
9. Educational use only — no professional advice or guarantee
PilotIQ is an educational tool. Its content, including any AI-generated explanations, is for study purposes only and does not constitute aviation, flight-instruction, regulatory, safety or legal advice. PilotIQ provides aviation exam preparation content and is not official CASA material. Always verify aviation information against current CASA publications, the Civil Aviation Safety Regulations, aircraft documentation and the guidance of an appropriately qualified flight instructor. We do not guarantee that you will pass any CASA examination. Aviation regulations, airspace and procedures change over time and you are responsible for verifying information against current authoritative sources.
10. AI features
Some features may use third-party AI models. AI output may be inaccurate or incomplete and must not be relied upon as a substitute for authoritative sources, official CASA material, or the judgement of a qualified flight instructor. Do not enter confidential or sensitive personal information into AI features.
11. Privacy
Our collection, storage and use of personal information is governed by our Privacy Policy, which forms part of these Terms.
12. Third-party services
The Service relies on third-party providers (hosting, authentication, payments, email, analytics, AI). Your use may be subject to those providers' terms. We are not responsible for third-party services we do not control.
13. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties not expressly stated. We do not warrant that the Service will be uninterrupted, error-free, or that content is accurate, complete or current.
14. Limitation of liability
To the maximum extent permitted by law, PilotIQ will not be liable for any indirect, incidental, special or consequential loss. Where liability cannot be excluded (including under the Australian Consumer Law), our liability is limited, at our option, to re-supplying the Service or refunding the fees paid for the relevant period.
15. Suspension & termination
We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.
16. Changes to these Terms
We may update these Terms from time to time and will post the updated version with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.
17. Apple App Store — licensed application terms
These additional terms apply whenever you download or use a PilotIQ application from the Apple App Store (the "App"). In the event of any conflict, this section governs for the App:
- Apple is not a party. These Terms are concluded between you and PilotIQ only, and not with Apple. PilotIQ, not Apple, is solely responsible for the App and its content.
- Scope of licence. PilotIQ grants you a personal, non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This licence complements the licence granted in section 8.
- Maintenance and support. PilotIQ is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- Warranty. PilotIQ is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. PilotIQ, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, PilotIQ (not Apple) is solely responsible for the investigation, defence, settlement and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the App.
- Third-party beneficiary. You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
